Regular Council Minutes - 2020/12/17The Corporation of the Township of Malahide December 17, 2020 — 7:30 p.m. The Malahide Township Council met via videoconference. The Manager of Information Technology and the Chief Administrative Officer/Clerk were present in Malahide Community Place, at 12105 Whitaker Road, Springfield. is Due to the COVID-19 pandemic, the Mayor, Members of Council, and some Municipal Staff participated remotely. The following members were present: Council Members via Videoconference: Mayor D. Mennill, Deputy Mayor D. Giguere, Councillor R. Cerna, Councillor C. Glinski, Councillor M. Moore, Councillor M. Widner, and Councillor S. Lewis. Staff present in Council Chamber: Manager of Information Technology C. Coxen and Deputy Clerk D. Wilson. CALL TO ORDER: Mayor Mennill took the Chair and called the meeting to order at 7:30 p.m. Mayor Mennill wished everyone a very Merry Christmas and expressed his desire that the community could unite in the New Year. DISCLOSURE OF PECUNIARY INTEREST and the General Nature thereof: Councillor Widner disclosed a pecuniary interest with respect to Council Agenda Item (e) (ii) regarding the Drainage Report — Petition for Drainage — Slansky Von Groh. The nature of the conflict being that a Junior Partner at Spriet Associates is an immediate relative of his. PRESENTATIONS/DELEGATIONS/PETITIONS: 40 Public Meeting — Zoning By-law Amendment, as submitted by Cornelius and Margaretha Penner, relating to property at Part Lot 21, Concession 9, Geographic Township of Malahide. No. 20-530 Moved by: Max Moore Seconded by: Rick Cerna THAT the Public Meeting concerning the Zoning By-law Amendment Application of Cornelius and Margaretha Penner relating to the property located at Lot 21, Concession 9, be called to order at 7:31 p.m. Mayor Mennill advised that the purpose of this Public Meeting is to consider an application to amend the zoning of the subject property located at 53250 College Line, being Lot 34, Concession 9, Malahide, from the General Agricultural (A2) Zone to the Small Lot Agricultural (A4) and Special Agricultural (A2) Zones. 40 Mayor Mennill asked the Deputy Clerk to advise and confirm on the method and date of notice given for this meeting. The Clerk advised that this public meeting was advertised in the Aylmer Express on November 25 and December 2, 2020. In addition, affected property owners within 120 metres were sent a notice by prepaid first class mail that was posted at least twenty days prior to this meeting. Mayor Mennill requested the Director of Development Services to provide an overview of the application. The Director advised that the purpose of the proposed amendment is to change the zoning on a small, vacant parcel from the Village Residential One (VR1) Zone to the Village Residential One -Holding (VR1-H-1) Zone. The lands to be rezoned to VR- H-1 comprise an area of approximately 1,340 square metres (0.3 acres), a frontage of 20 metres (66 feet) and a depth of 67 metres (220 feet). The parcel comprises the front portion of a larger lot intended to be ultimately developed as a residential plan of subdivision. The change in zoning of the subject lands to VR1-H-1 would ensure that the use of the parcel is persevered for its intended purpose and function as future road access to the aforementioned plan of subdivision and is being requested to satisfy conditions of Application for Consent E59/19 granted by the County of Elgin Land Division Committee. Mayor Mennill asked the Deputy Clerk to provide any comments received from the circulated agencies and landowners. The Deputy Clerk advised that correspondence has been received from the Catfish Creek Conservation Authority and Bill Maclntyre, neighbouring property owner, both expressing concerns. The Director of Development Services advised that Mr. Maclntyre's concerns were with respect to a future road along his property and how that would affect his property in the future. The Director advised that Mr. Maclntyre's concerns have been addressed. The Director noted that the correspondence received from the Catfish Creek Conservation Authority indicated that they had concerns and upon following up with the Authority, it was determined to be a clerical error and that they did not have any concerns with this application. Mayor Mennill asked if any persons were in attendance that wished to make any comments regarding the application and there were none. Mayor Mennill advised that the Council will consider all comments received when making its final decision on the application. Director of Public Works - Petition for Drainage — Slansky Von Groh Councillor Widner declared a conflict of interest with respect to Council Agenda Item E (ii) relating to the Slansky Von Groh Petition, retired from the meeting and abstained from all discussions and voting on the matter. Director of Financial Services - Feasibility Study for Connectivity Services No. 20-534 Moved by: Rick Cerna Seconded by: Scott Lewis THAT Report No. FIN 20-24 titled "Feasibility Study for Connectivity Services" be received; AND THAT the Feasibility Study for Connectivity Services Project be awarded to Community Fibre Company, of Lanark, Ontario, at a cost of $49,000 (plus applicable taxes). Chief Administrative Officer/Clerk - Video Conferencing Solutions for Council Meetings No. 20-535 Moved by: Dominique Giguere Seconded by: Rick C THAT Report No. CAO-20-21 entitled "Video Conferencing Solutions for Council Meetings" be received; AND THAT the quotation received from PA Shop, of London, Ontario, in the amount of 22,362.00 (plus applicable taxes), to provide and install a video conferencing system for Council meetings at Malahide Community Place; AND THAT the Municipal Staff be authorized and directed to take the necessary actions to facilitate the installation of a video conferencing solution in Malahide Community Place to better enable electronic participation and the livestreaming of Council meetings; it being noted that such system can be redeployed to the former Council Chambers in the future.
